political, legal analysis of Trump immunity case ruling


SPRINGFIELD, MA (WGGB/WSHM) – There may have been more legal news for former President Donald Trump, but it may not be at the top of the minds of those who could put him back at 1600 Pennsylvania Avenue.

“Essentially, it’s his conservative majority that’s giving him a pass in a sense,” said political expert Paul Robbins.

The Supreme Court may not have given Trump complete immunity, but his official acts can stay under the lid, so the former president turned convicted felon after a guilty verdict in his Manhattan hush money case may be out of the woods legally now, but what does this mean for his political future?

“You’ll notice after the New York case, his fundraising went up, even his numbers went up,” Robbins added. “Recent New York Times poll, the battleground states, when voters were asked whose more of a threat to democracy, Trump or Biden, more said Biden.”

Robbins expects the former president, who’s noted disdain for his legal legacy, said he’ll be quick to turn something sour into something sweet.

“The way Trump is going to play it is ‘This is a victory. There’s official acts that I can do and that’s what I was doing on January 6,’” Robbins noted.

Let’s talk legally. Defense attorney Joe Pacella walked us through the legal ramifications and the key role lower courts now play.

“As Justice Sonia Sotomayor says in the dissent, she’s sort of makes the argument that it’s blanket immunity because anything can be an official act for a president,” Pacella said. “Courts will be required to do an intense factual decision-making process on whether something is an official act or unofficial act without a whole lot of guidance.”

In the court of public opinion, which will matter most in the coming months, some voters told Western Mass News that it may not have much of an impact…

“It doesn’t really affect me on how I feel because overall. Overall, whoever’s in office is still all messed up,” said Jeremy Officer of Springfield.
